Obama health care plan - Requiring health insurance is clearly constitutional : Critics of the Obama health care plan who call for its repeal claim that the mandate for all Americans to buy health insurance is unconstitutional.
When asked why this mandate is unconstitutional, but the requirement for drivers to insure their cars is constitutional, the response is that people can choose to not drive a car. This is of course ridiculous in our current society, in which the vast majority of people must own and drive cars.
So, an equally ridiculous, but equally valid, response to the health care plan critics is that people do not need to buy health care. If they so choose, they can rely on old home remedies, faith healers, and prayer for their health needs. If they legally choose to never use the American health care system, they do not have to pay for health insurance.
The Obama health care plan ends private insurance companies' abuses of the American public. The insurance companies can no longer place lifetime limits on patients or drop their coverage when a patient gets seriously ill. The plan extends young adults' coverage under their parents' policies, prohibits discrimination against children with pre-existing conditions, and restricts the use of annual limits on patients' coverage.
All of these advantages to all Americans cannot be implemented unless everyone is in the system. Since the choice of not using the American health care system is not a realistic option, it is only fair to mandate that all Americans have health insurance, and to agree that it is as constitutional as requiring all drivers to have car insurance.
